General Information

On June 1, 2009, the following entities filed voluntary petitions for relief under chapter 11 of the Bankruptcy Code (the “Initial Debtors”):

  • Motors Liquidation Company (f/k/a General Motors Corporation)
  • MLCS, LLC (f/k/a Saturn, LLC)
  • MLCS Distribution Corporation (f/k/a Saturn Distribution Corporation)
  • MLC of Harlem, Inc. (f/k/a Chevrolet-Saturn of Harlem, Inc.)

On July 5, 2009, an order was entered approving the sale of substantially all of the Initial Debtors’ assets to a new and independent company (now known as General Motors Company) under section 363 of the Bankruptcy Code. The sale closed on July 10, 2009.

On September 16, 2009, the Bar Date Order was entered establishing November 30, 2009 at 5:00 p.m. (Eastern Time) as the deadline to file proofs of claim (including claims under section 503(b)(9) of the Bankruptcy Code) against the Initial Debtors. Creditors have been notified and provided with a proof of claim form. Additional information about how to file a proof of claim can be found in the “Initial Debtors Bar Date Materials” link.

On December 18, 2009, a supplemental Property Bar Date Order was entered establishing February 10, 2010 at 5:00 p.m. (Eastern Time) as the deadline to file proofs of claim (“Property Proofs of Claim”) against the Initial Debtors by entities residing (the “Residents”) adjacent to or in the proximity of the material manufacturing properties of the Debtors as set forth on Exhibit “A” annexed to the Property Bar Date Order (the “Properties”). The Initial Debtors Bar Date Order which established November 30, 2009 as the general bar date for filing claims continues to apply in all respects to all other claims and entities. Residences within an approximate 0.5 miles of each of the Properties were notified of the Property Bar Date Order. On October 9, 2009, the following entities filed voluntary petitions for relief under chapter 11 of the Bankruptcy Code (the “REALM/ENCORE Debtors”):

  • Remediation and Liability Management Company, Inc. ("REALM")
  • Environmental Corporate Remediation Company, Inc. ("ENCORE")

An order was entered on October 15, 2009 (the “REALM/ENCORE Order”) allowing certain orders entered in the Initial Debtors’ chapter 11 cases to apply to the REALM/ENCORE Debtors. The REALM/ENCORE Order, among other things, provides for the joint administration of the REALM/ENCORE Debtors’ cases with the Initial Debtors’ cases under Case No. 09-50026 (REG). The Bar Date Order entered on September 16, 2009 does not apply to the REALM/ENCORE Debtors.

On December 2, 2009, The REALM/ENCORE Bar Date Order was entered establishing February 1, 2010 at 5:00 p.m. (Eastern Time) as the REALM/ENCORE deadline to file proofs of claim (including claims under section 503(b)(9) of the Bankruptcy Code) against the REALM/ENCORE Debtors. Creditors have been notified and provided with a proof of claim form for the REALM/ENCORE Debtors.
